Asbestos Management Plan
Regulation 4 of the Control of Asbestos at work Regulations 2006(the duty to manage asbestos in non-domestic premises) places a statutory legal obligation on persons and organisations, who own, occupy, manage or have responsibilities for such premises, to protect persons who work in them or visit them, from the risks to health associated with exposure to asbestos.
In many cases the ‘duty holder’ will be the person or organisation that has the responsibility for construction activities (e.g. any construction, alteration, conversion, renovation, repair, upkeep, redecoration or other maintenance, de-commissioning, demolition or dismantling of a structure) within the premises.
The regulation requires every ‘duty holder’ to ensure that a suitable and sufficient assessment is carried out as to whether asbestos is or is likely to be present within the premises and where this assessment shows that asbestos is or is likely to be present within the premises, to ensure that –
(a) a determination of the risk from that asbestos is made;
(b) a written plan identifying those parts of the premises concerned is prepared; and
(c) The measures which are to be taken for managing the risk are specified in a written plan.
Before arranging for any work to be done you should start by writing an 'asbestos management plan'. This should include as a minimum:
- Who is responsible for managing asbestos;
- A detailed asbestos register;
- Plans for work on or in the vicinity of asbestos materials;
- The schedule for monitoring the materials' condition; and
- Telling people about your decisions.
The plan must say who is responsible for what. It can be written or held as a computer based record. Make it easy to read and easy to find when you, or anyone else, needs it. It must also be easy to update.
